CG GUARANTEE
If an immigration application is denied by the competent authority because of a technical or documentary error attributable directly and exclusively to Common Ground, we refund 100% of the professional fees paid for the affected service, or we redo the file at no additional cost when legally and materially possible.
1. Nature of the Guarantee
The CG Guarantee is a limited and specific guarantee of professional and documentary quality, applicable only to the preparation and review of Files carried out by Common Ground.
The CG Guarantee is not a guarantee of outcome and implies no commitment regarding favorable decisions, response times, administrative criteria or decisions made by the competent authorities.
2. When it applies
The CG Guarantee applies only when all of the following conditions are met:
- An immigration application is formally denied or rejected by the competent authority
- The denial results directly and exclusively from a technical or documentary error attributable to Common Ground in preparing the file
- The client has fully met their contractual obligations, in particular those regarding providing truthful, complete and timely information
3. What it covers
For purposes of the CG Guarantee, a technical or documentary error attributable to Common Ground will be deemed to exist only when the denial or rejection results directly and exclusively from one of the following:
- Omission of documentary requirements expressly set out in the Migration Law, its Regulations, the Guidelines for Immigration Procedures or the Visa Issuance Guidelines, provided those requirements are objective, enforceable and applicable to the specific application
- Incorrect assembly of the file attributable to Common Ground, meaning the failure to include documents that the client provided correctly and on time, that had to be part of the file and were not included for reasons attributable to Common Ground
- Errors in organizing, classifying or submitting the file attributable to Common Ground that directly cause an express regulatory requirement not to be met, provided those errors do not stem from the client’s information or from documents prepared or issued by third parties
4. What it doesn’t cover
The CG Guarantee will not apply, under any circumstances, when the denial, rejection, deficiency notice, additional request, closure, delay or any other issue with the application results, directly or indirectly, from:
- Requests for additional information, documents or evidence made by the authority under its discretionary powers, including those exercised “to better resolve” the case
- False, incomplete, inaccurate, contradictory, outdated or late information from the client, related persons or third parties
- Documents prepared, issued or certified by third parties, including foreign authorities, employers, educational institutions, notaries, translators, experts or certifying officers
- Regulatory changes, amendments to guidelines, administrative criteria, internal policies or official interpretations issued after the services began or the application was filed
- Subjective or discretionary criteria of the authority, including assessments of ties to Mexico, financial solvency, immigration profile, intent of stay, consistency of activities or any other element that cannot be objectively verified
- The client’s failures, omissions, delays or absences, including missing signatures, personal appearance, payment of fees, or attendance at appointments, interviews or requests within the stated deadlines
- Acts or omissions of third parties unrelated to Common Ground, including authorities, government platforms, courier services, consular services, translators, paperwork agents or outside providers
- Acts of God or force majeure, including government system failures, administrative closures, health emergencies, political events or any circumstance beyond Common Ground’s reasonable control
5. Guarantee benefit
When the CG Guarantee applies, Common Ground will offer the client, as the exclusive remedy, one of the following options, at Common Ground’s choice and based on the nature of the error and the legal viability of the application:
- A refund of 100% of the professional fees actually paid for the specific service to which the affected file corresponds; or
- Redoing the file at no additional cost, when legally and materially possible
In no case will the CG Guarantee benefit exceed the fees actually paid by the client for the specific service involved.
6. How to claim the Guarantee
The client must notify Common Ground of the denial in writing, attaching the corresponding decision, within ten (10) business days of being formally notified of it.
Common Ground will review the case and inform the client, within a reasonable time, whether the CG Guarantee applies, explaining the grounds for its decision.
7. Exclusive remedy
The CG Guarantee is the sole and exclusive remedy for claims related to the technical or documentary quality of files, and replaces any other express or implied warranty to the fullest extent permitted by applicable law.
8. Contractual document
This text is a summary for information purposes. The CG Guarantee is governed entirely by Exhibit B of the Professional Immigration Services Agreement signed between Common Ground and the client. In case of any discrepancy between this summary and the signed Exhibit B, Exhibit B prevails.
